Succinylcholine is a neuromuscular blocking agent and has NO anesthetic properties. This is the same drug that Dr. Richard Sanford used for castration at the Broken Arrow holding facility in Fallon, Nevada, causing the deaths of several geldings by pulmonary hemorrhage.
Why in the world would the BLM continue to use this dangerous and outdated drug? Well, why not? If you don't give a damn about the suffering and/or death you inflict on an innocent, gentle, intelligent Being who's only crime is existing, you can do whatever you want.
I won't write out what I would LIKE to do to these heartless zombies because I try to maintain a G rating for my blog, but I'm sure I can leave it to your own imagination to fill in the blanks.
Truly, words fail me. I'm coming to believe there is NOTHING these people will not stoop to in order to remove these magnificent creatures from the land that is theirs as native wildlife and by mandate of law. Whatever the reason they think they have for these atrocities, in reality this is nothing but mindless madness.
To those in power who have done NOTHING despite the endless pleas, I say to you that you're not fit for the position you hold, and, if it is within my power, you will not keep it. One of the many incredible things about horses is that they do not hold grudges. I however, do.
BLM to continue castrating wild horses using disputed anesthesia protocol

It's official. The BLM intends to disregard HSUS veterinarian Dr. Eric Davis's "serious concerns" about the use of the paralytic drug, succinycholine, as an anesthesia agent during wild horse castrations. It doesn't matter that succinylcholine has already caused the deaths of several geldings castrated by Dr. Richard Sanford at the Broken Arrow holding facility in Fallon, Nevada. And apparently, it doesn't matter that the drug routinely causes potentially fatal respiratory difficulties that are best addressed by pressurized oxygen equipment that is not even available at BLM facilities.
No, it doesn't matter what anyone says: the BLM and its veterinarians make their own rules, often without regard for what is in the best interests of the wild horses they purportedly manage. In response to inquiries from Leslie Peeples about the BLM's continued use of succinylcholine during castrations, BLM Public Affairs Officer Jeff Fontana furnished a statement from the agency which claims that "complications and side effects are rare."
Now the BLM is asking for an "independent study" on their management practices by the National Academy of Science, supposedly to start on January 1, 2011. Well, why not. After the BLM finishes their blitz on the horses this year, there won't be enough horses left in the wild to worry about. Even if the NAS were to tell the BLM to cease and desist rounding up these horses, suggest an on-the-range-management plan, and the BLM actually implements such a plan-which I'll believe when I see it-are enough herds left that are genetically viable enough to secure these horses' future? Not if the BLM can possibly prevent it, no there will not be enough left with large enough gene pools to survive long term. This was the whole idea after all. If it weren't, the BLM would STOP the roundups until the study was completed. Instead, they are moving at an ever increasing pace to eradicate the horses before someone steps up and stops them.
The NAS can criticize the BLM's management practices for the last 40 years to their hearts' content, and it won't bother the BLM at all. If the horses are gone, they're gone, and not all the hindsight in the world will bring them back. So, I have a question. The report below has been around for quite a while, and I want to know why it seems to have been completely ignored by the BLM, and everyone else for that matter. Why wasn't this enough to at least consider stepping back-just temporarily!-to look at the other options that have always been at the BLM's discretion.

Responsible advocates understand that areas suffering from verified overpopulation are a different matter. Alberta's wild horses endure a relatively low survival rate among foals. The climate is challenging and predators are abundant.
Cows have no upper front teeth, only a thick pad: they graze by wrapping their long tongues around grass and pulling on it. If the ground is wet, they will pull out the grass by the roots, preventing it from growing back. Horses have both upper and lower incisors and graze by "clipping the grass," similar to a lawn mower, allowing the grass to easily grow back.
In addition, the horse’s digestive system does not thoroughly degrade the vegetation it eats. As a result, it tends to “replant” its own forage with the diverse seeds that pass through its system undegraded. This unique digestive system greatly aids in the building up of the absorptive, nutrient-rich humus component of soils. This, in turn, helps the soil absorb and retain water upon which many diverse plants and animals depend. In this way, the wild horse is also of great value in reducing dry inflammable vegetation in fire-prone areas. Back in the 1950s, it was primarily out of concern over brush fires that Storey County, Nevada, passed the first wild horse protection law in the United States.

Grossly inadequate veterinary care is causing suffering and death to newly gelded young horses from Calico according to Dr. Eric Davis, Humane Society Veterinary Medical Association (HSVMA).
Personally, I've never been impressed with the HSUS or their veterinarians. That's why this report is especially chilling.
And indeed, at least nine recently gelded males at the facility have perished during the last three months as a direct result of the castration complications cited in Dr. Davis's report, including one (#1269) who died during the second week of August.
This unconscionable callous cruelty to our American Mustangs must end. The BLM has killed so many and lied about it. They misled a Federal Judge in order to continue driving horses down mountains in the heat of a Nevada summer, leaving the ones that went down to die where they fell - except for the few that they shot. Now the BLM claims the deaths they DO admit to were due to "preexisting conditions" of one kind or another.
These horses were fine - healthy and HAD WATER before the BLM and Sue Cattoor, their helicopter contractor, started their "gather."

An independent observer who recently returned from scouting the Herd Area in north Elko County, Nevada where the Owyhee portion of the Tuscarora Gather took place has photographic evidence that one of the wild horses appears to have been driven to his or her death over rocky cliffs, presumably by Cattoor, the BLM's helicopter contractor.
Though no such fatality was ever reported by the BLM, Katie Fite, a Biodiversity Director for the Western Watersheds Project, was able to document it during her visit to the area on July 25th and 26th. Her photograph depicting a horse lying dead on the rocks near the Owyhee River was submitted in support of Laura Leigh's legal motions against the BLM on the Tuscarora matter, the most recent of which was filed on Friday, July 30th.
Ms. Fite explained:
"I noted evidence that horses had been driven down the river bed and held in temporary corrals. Also noted a horse that appears to have been driven onto the rocks."
Ms. Fite's photographs were taken at the South Fork of the Owyhee River, north of the Owyhee roundup trap site, where she observed four places at which wild horses have access to water, contrary to the BLM's prior assertions that because no water was available to the mustangs in this Herd Area (HA), an "emergency rescue gather" was justified and necessary.
Another observer, wild horse advocate Sandra Longley, also visited the Owyhee roundup area on July 16th and 17th, to document forage, water sources, cattle, and gates. She reported:
"I stood there on the Owyhee on July 17th amidst fields of wildflowers, water pouring out of the sides of mountains, and springs with water running down and alongside of roads. There was nothing but cattle, but over a few hills, many wild horses were dying. . .No horses could be documented except an ecosystem littered with the dead bodies of horses, who had suffered heat stroke at the hands of Sue Cattoor, the helicopter contractor.
There is so much more to come. We have yet to get the total of horses who died or were 'rescued' with a bullet out on the desert where they were stumbling around suffering from heat stroke from being pushed by the helicopter. Many of those would have been foals. . .By not counting those horses as 'gather' deaths, but due to drought, the BLM is allowed to escape being blamed for the largest massacre during a roundup."
It is true that the BLM has never acknowledged, or reported, the deaths of the fallen horses Ms. Longley describes, but their stories must be told. In a press release issued today, the agency admits that 34 wild horses have died as a direct result of the Tuscarora roundup, but it's clear that the actual number who have perished at the BLM's directive is much, much higher.
Government Lawyers Mislead Federal Judge on Wild Horse Water

HOUSTON, (Horseback) – When Laura Leigh, an author, artist, journalist, and litigant chased the BLM into the desert to observe wild horse capture after a federal judge told her she could do so, she wasn’t allowed to see horses – but she did see water.
Judge Larry Hicks lifted his temporary injunction and permitted the federal Bureau of Land Management to capture horses in the fierce July desert heat of Nevada. As in previous death chases, the result was predictable. Horses dropped after being relentlessly stampeded by a roaring helicopter owned by BLM contractor, Cattoor Livestock Roundups out of Nephi, Utah. The federal agency had lied to the judge, telling him that death by thirst was imminent if they weren’t removed.
Thus far, 21 horses and foals have died after the latest high summer stampedes.
Hicks granted the plaintiff, Leigh, a first amendment stake in the chase. He told her it was unconstitutional for the BLM to ban her from observing the horses. In reply, the agency pulled off a cowboy hat trick of sorts in the desert. They moved the trap, the pen where the wild animals were to be driven, onto private land in a mountain canyon out of sight and then told the sheriff’s cops to arrest trespassers, including the litigant who had just won the right to see what BLM was doing in their “gather” first hand.
While Leigh didn’t get to see the objects of the BLM chase, North American Mustangs, she spotted something equally important and precious in the desert – water at the fenced off Desert Ranch Reservoir.
“While the reservoir is located on BLM public land, the water in the reservoir is privately owned (i.e., the private owner holds the water rights in accordance with State of Nevada water law),” said BLM’s Washington spokesman, Tom Gorey. “The reservoir is mostly fenced, but the fences are constructed in a manner that allows wild horses access to the privately owned water in at least three locations. As a result, wild horses are able to move freely to and from the water using the large gaps in the fencing. In short, access to the reservoir water by wild horses is not blocked.”
If access to the water hole was open in three places, Leigh had caught the BLM lying to a federal judge.
“Desert Ranch Reservoir on public land is less than 5 miles from the trap site,” Leigh told Horseback Magazine late Monday. “BLM has the authority to utilize resources on private property to deal with emergencies. (BLM Director Bob) Abbey declared this issue in Owyhee an emergency.”
Gorey acknowledged late Tuesday that there is water available to the horses that are being stampeded by the BLM contractor.
“In general, water within the Owyhee Herd Management Area (HMA) is provided primarily by unfenced public land reservoirs (water catchments),” he said. “There is also one spring, called Bookkeeper Spring, which is located on unfenced private land within the HMA. This spring is normally adequate to water a small number of wild horses, but because of drought conditions, there is very little water available for use this year.”
Claiming extreme drought conditions, the BLM has delivered more than 30,000 gallons of water to the horses in the Owyhee HMA since Monday.
By admitting that water on public land is privately owned, Gorey raised a significant issue. What was the federal government thinking when it privatized an asset as precious as desert water, selling it out of government control? Moreover, when was it sold, for how much, and to whom?
“My assumption is that the BLM has never held the right to this water,” Gorey said.
It the government doesn’t own the water on federal land, who owns it?
Gorey has promised to research the ownership issue of water BLM lawyers claimed was nonexistent, so scarce, the deaths of hundreds of otherwise healthy horses and foals was imminent.
“Why did the BLM choose to press a stressed population through the round up instead of stabilizing the situation and waiting?” Leigh asked. “The claims made in the report given to a federal judge outline a population so fragile that BLM projected would be dead in three days (if the agency was not allowed to round them up.)”
“In the event of an emergency (such as one declared by Bob Abbey in this case,
the BLM can utilize resources on private land (not just public) and reimburse
the landowner,” Leigh said. “If the horses were gong to die off at the rate of 75 percent they had the authority to open gates.”
Leigh has filed briefs charging the BLM with contempt of court.
Mustang Advocate Finds BLM Violates Own Rules, Files Lawsuit
Hundreds of young wild horse foals risk death in imminent Nevada roundup
Reno NV (July 9, 2010)—One woman from Herd-Watch, a program of The Cloud Foundation, studied the newly published Bureau of Land Management (BLM) Wild Horse and Burro handbook and caught BLM in the act of violating their own protocol for the Tuscarora (Owyhee Complex) roundup. The handbook states roundups are prohibited until six weeks after foaling season which ends on June 30th. Therefore the earliest date to start the roundup is August 11th. Laura Leigh, Project Manager of Herd Watch filed a lawsuit today in US District Court in Nevada to stop the roundup.
"I found their error right in the BLM's management handbook," explains Leigh adding, "The BLM disregards their own rules when it comes to ‘managing’ wild horse population.”
Based on past experience and the current rush to remove 6,000 wild horses in three months, The Cloud Foundation believes that the BLM's priorities are based on contractor availability not humane treatment of wild horses—especially foals, some of whom may be only weeks or days old.
The Foundation is requesting that humane observers and members of the public be present during all phases of all the roundups. Since the deadly Calico roundup in NW Nevada, BLM has tightened restrictions, preventing the public and humane observers from viewing the horses adequately. In the case of Tuscarora, the public will not be allowed to view any round up activities for the first two weeks.

Ginger Kathrens, Executive Director of The Cloud Foundation, shares Leigh’s concerns that "more foals may have their feet literally run off because they are too young to be chased by helicopter over sharp, volcanic terrain for miles in the hottest month of the year. At least two foals died a horrible death like this in the Calico roundup. Didn’t BLM learn anything from Calico?”
More than 100 wild horses died and more than 40 spontaneous abortions occurred as a result of the Calico roundup.
“Currently, the only way to gain accountability—with an agency apparently left to police itself—is for a member of the public to file suit,” remarks Leigh. Leigh’s efforts are being supported by Grassroots Horse, an organization based in grassroots activism to prevent cruel wild horse roundups.
“If this roundup were being conducted in a safe manner,” says Leigh’s attorney Gordon Cowan of Reno, Nevada “one would make the assumption that the BLM would want the public to witness its entirety. Barring observers and press raises concerns.”
BLM Admits Helicopter Stampede Caused Wild Horse Deaths, Refuses Outside Observers in Nevada Census

HOUSTON, (Horseback) – The federal Bureau of Land Management, under siege by press and public for it’s handling of offshore drilling, again has proven it is an agency with a tin ear when it comes to public relations.
With 150 horses and foals now dead in the wake of the most deadly “gather” in BLM history, the agency continues with an apparent government cover-up of the number of horses remaining in Nevada’s remote Calico Mountains.
The BLM refused to allow outside observers on an equine census of the area in late June, according to national spokesman Tom Gorey. It even covered up the fact that a census was being taken at all until after the fact, despite pleas from wild horse activists to be allowed to go along on census flights as independent observers.
Last week, in a detailed report of an independent fly-over of the Calico “gather” area acclaimed naturalist Craig Downer saw only sparse evidence of any remaining horses on hundreds of thousands of acres of BLM land. He also recorded thousands of cattle.
“The Calico Complex aerial census was completed Sunday and we expect to issue a news release on the results shortly (within the next day or so),” Gorey said. “No third parties/independent observers were allowed to ride in the aircraft conducting the survey.”
Gorey cited existing BLM policy for the agency refusal to allow outside observers on the observation flights.
“This is in accordance with existing BLM policy and is done for reasons of safety and liability. Additionally, observers must be trained. Accuracy of the counts strongly depends on the skill of the observer and is affected by the ruggedness of the terrain and the presence of vegetation cover.”
Downer has spent decades observing wild horse in their natural habitat, both from the air, and from the ground.
BLM personnel have a long history of mathematical errors in their reports as cited in several Horseback stories last year.
Ironically, other government agencies routinely allow the press and other observers on flights, including in war zones where the media is often imbedded with soldiers, sailors, marines, and airborne troops in combat. The independent observers are acknowledged to deliver accurate reports, even in the stressful environment of war with little or no training before an engagement.
Gorey acknowledged a large number of deaths came from horses trying to escape a roaring helicopter chase by a Utah contractor hired by the BLM.
“Yes, the BLM acknowledges that at gathers some fatalities directly result from the horses being driven by the helicopter,” Gorey said. “The direct mortality rate resulting from helicopter-driven gathers is usually less than one percent.”
The BLM declines to acknowledge what is a statistically acceptable death rate on its roundups of wild horses. The Calico roundup took place in the dead of winter in rocky mountainous terrain where horses were run over miles and miles of rugged wilderness.
Gorey detailed the carnage.
“Seven died or were euthanized at the gather site; 101 have died or were euthanized at the Fallon facility. The BLM does not keep a count of miscarriages, but we did note in the daily reports those miscarriages that we observed.”
Two foals died after their hooves were run off as they tried to escape the roaring helicopter.
“Two foals died as you described,” Gorey said, “No other horses died of hoof abscesses.”
In the Calico “gather,” something went dreadfully wrong.
“In 2009, the number of direct fatalities (out of more than 7,500 horses gathered) was 0.53 percent,” Gorey said. “Some indirect mortality also occurs, usually associated with older horses in poor to very poor condition when gathered. These already weakened horses, many of which would likely die on the range if not gathered, are examined by staff professionals and veterinarians and are euthanized if they are unlikely to improve or do not respond to treatment.”
The government spokesman painted a benign word portrait of humane euthanasia of geriatric horses. Yet the BLM reports published on the Internet records what amounts to wholesale slaughter of wild horses from Calico in which some were routinely put down by government vets, one of whom was unlicensed to practice in Nevada.
I did vote for you. I was intrigued by your call for "change". You signaled a dramatic new course, one of openness and inclusion. Certainly I applauded your choice of Joe Biden as vice president, a staunch animal welfare advocate.
The promises
During the 2008 campaign you said, "Federal policy towards animals should respect the dignity of animals and their rightful place as cohabitants of our environment. We should strive to protect animals and their habitats and prevent animal cruelty, exploitation and neglect.... I have consistently been a champion of animal-friendly legislation and policy and would continue to be so once elected." You announced that you had co-sponsored legislation to stop the sale for slaughter of wild free-roaming horses and burros. During the election you signed on as co-sponsor to the bill to ban horse slaughter for human consumption. When asked specifically during the campaign, "Will you support legislation ...to institute a permanent ban on horse slaughter and exports of horses for human consumption", you gave an unqualified "Yes". Today, in January, 2010, you are presiding over one of the deadliest, most cruel and unnecessary government roundups of wild horses ever documented by BLM.
As of this writing, more than 2 dozen horses have been killed by helicopters used by your administration to run them off their legally protected herd areas and corral them in long term holding pens. The hooves of two little foals have literally torn off as they ran for their lives from the BLM. BLM's Richard Sanford DVM reported on one, "Multiple hoof sloughs were noted and the foal was euthanized for humane reasons. The cause of these hoof abscesses/sloughs was most likely hoof trauma from the gather operations."
Several mares have also aborted spontaneously or miscarried. This after being forced to run miles from a helicopter and trapped in a corral, terrified, traumatized and forever separated from their herds, their families. A long time BLM official whom you promoted to the job of Assistant Director for Renewable Resources and Planning in the BLM, Edwin Roberson, claims the spontaneous abortions are "the result of the poor condition of many of the older mares and ... directly related to lack of forage on the range." Except that they weren't miscarrying on the range and didn't do so until after they were forced to run hundreds of miles, extremely afraid, and lost their families and freedom forever. Your administration would have us believe that the mares all miscarried in the past few days because of years of eating the forage on the range and it had nothing to do with the severe trauma of the roundup they had just endured?
Wow, your words about respecting animals as co-inhabitants and protecting them in their habitat really ring hollow, don't they? Not to mention I do not see that your administration has lifted a finger, let alone "championed", for "animal-friendly legislation and policy" as promised.
Thousands of citizens have gathered at dozens of ongoing protests of
BLM's policy of extermination towards our wild horses and burros. Tens and even hundreds of thousands more have written and called your administration and Congress, asking you for a moratorium on wild horses and burro roundups, an evaluation and change in policy, like the one you promised. But you seem to have dug in, your attitude reminiscent of President Richard Nixon, refusing even to acknowledge the outcry, let alone the cruelty.
Taxpayer money - the budgets
Calico is only the latest of the roundups of wild horses that have actually accelerated during your administration. In FY 2008, the cost of rounding up and holding these animals was approximately 81.3% of the $36,201,000 budget for the total wild horse and burro program. The BLM wild horse adoption program consumed another 13% of the total budget, leaving a meager 5.8% for monitoring and managing herd areas, census, and compliance inspections. The 2009 budget was $40,613,000 with the increase used for more roundups and holding costs. (BLM report - 2010 Budget Justification)
Then you proposed for FY 2010 a substantial increase in the budget for the wild horses and burros program for a total of $67,486,000 with the entire additional $26, 873,000 to be used for rounding up 12,000 horses and holding what will be a total of about 40,000 horses in pens. Now for FY 2011 you have requested an additional $12 million apparently to defray the costs of holding wild horses and burros in corrals and long term holding facilities.
How do you explain to laid off workers, unemployed fathers and mothers, struggling businesses, and taxpayers shouldering substantial government debt in this worst of economic times, why you want to continue, even step up, round ups of nearly all of the wild horses and burros and put them in costly holding facilities?
What's next - deer, elk, squirrels, rabbits, raccoons?
You appointed Ken Salazar to be the Dept. of Interior Secretary. Sec'y. Salazar supports horse slaughter; he is an avid supporter of taxpayer subsidies of livestock grazing on public lands which BLM has given priority. It has been said that grazing livestock on public lands is a "$132 million loss to the American taxpayer each year and independent economists have estimated the true cost at between $500 million and $1 billion dollars a year." Another burden for the taxpayers.
Sec'y. Salazar also supports oil and gas development so this appointment probably made Senate Majority Leader Harry Reid (D-NV) happy. He conspired with then Sen. Conrad Burns (R-MT) in 2004 to legalize slaughter of wild horses and burros and has through special laws and otherwise, facilitated removals of large numbers of these animals from lands in Nevada his contributors want for development, oil and gas drilling and production, mining, recreation and the like. The cattle and even sheep would be allowed to stay and their numbers increased. Whatever is profitable at the expense of the American people's public lands.
Horse slaughter
Needless to say, since your election, you've not said a word about supporting legislation to ban horse slaughter. I guess if you were planning to keep that promise, you would not have appointed Ken Salazar or Bob Abbey. Your BLM Director, Bob Abbey, is a long time BLM employee who as director of the Nevada BLM office signed off on numerous wild horse and burro roundups and sales for slaughter.
Mr. President, the issue is not one of balancing interests, the wild horses and burros, the ranchers, energy development. The issues are integrity, compliance with our laws, and humane treatment of animals.
Sec'y. Salazar has disseminated the outline of a plan, really a culmination of Bush era BLM meetings, that will basically mean moving wild horses and burros to pastures, even feedlots in the Midwest and East, from herd areas and ranges in the west where they are supposed to be "free roaming", managed at the "minimal feasible level" and protected from "capture", "harassment" and "death".
Not only is such a plan contrary to the promise of the Wild Free Roaming Horses and Burros Act, 16 USC §1331 et seq., Nena Winand, DVM, has advised such a move makes no sense because taking horses from their native habitat to pastures in the Midwest or East with different nutrients is likely to cause them to suffer metabolic syndrome. This is one reason why there is an effort to protect "animals and their habitat", recognize "their rightful place as co-habitants" of the earth. (Do you remember that you said that?)
But this, like the explanations for the miscarrying mares, is typical of the lack of science underlying BLM's management of the wild horses and burros. Secy Salazar has asserted as his premise for this plan that exploding numbers of wild horses are responsible for the degradation of the range and must be removed. He adds that this is for the horses and burros' own good because they are also starving. Secy Salazar has asserted this over and over as if repeating it will make it true.
President Obama, your administration has used newspapers and its own websites to try to convince the American people of this. One blogger would remind that it is illegal to use appropriated funds to hire publicity experts. 5 U.S.C. 3107 "Appropriations law "publicity and propaganda" clauses restrict the use of funds for puffery of an agency, purely partisan communications, and covert propaganda." BLM fails to include "Letters in Opposition" to the agency's action, and also does not in its "News Releases and Editorials" any news reports or editorials critical of the agency's actions.
The truth
In 1990 the GAO found the range was in the best condition it had been in during the past century. The GAO found any degradation was the result of livestock grazing and suggested removal of cattle, not wild horses and burros. The removal of wild horses at that time was something done largely to appease ranchers.
Since 2001, however, over 74,000 wild horses and burros have removed from the range, and now one year after you took office and stepped up the Bush era removals, there are almost more wild horses in holding facilities than roaming free. As of October, 2009, BLM was holding 32,000 animals in holding facilities. More now since the roundup of the Calico horses that began in late December, 2009.
The truth is there are fewer free roaming wild horses now than in 1974. Wild horses make up only .5% of grazing animals on public lands; they are outnumbered by cattle at least 200 to 1. The BLM manages more than 256 million acres of public lands. Cattle grazing is allowed on 160 million acres, while wild horses are restricted to 26.6 million acres of land that is shared with cattle.
Take as an example the BLM's zeroing out or eliminating 12 herds in Lincoln and Nye Counties in Nevada in September, 2009. BLM estimated there were 1,357.43 acres per wild horse in one herd area, about 350 horses; and 3,377.38 acres per horse in another herd area, about 270 horses. The BLM zeroed out all of these herd areas, known as the Seaman including Golden Gate, and White River Herd Areas and the Caliente Herd Area. Not one wild horse will be allowed to live anywhere in these herd areas despite that in 1971 they were designated for the wild horses and burros.
In the Calico Mt. Complex, site of the current roundup of 90% of the estimated 3,100 horses living there, there are approximately 175 acres for each horse.
In 2007 BLM said there were 700 horses there and in 2008, there were said to be so few horses that BLM decided not to monitor them further. BLM then authorized what amounted to a 300% increase in cattle in one allotment of this area. Just a few months later in 2008 BLM decided the numbers of horses in this area had exploded and were degrading the range. In 2009 BLM employees responsible for monitoring the wild horses and burros in this area testified they were "surprised" to hear about an exploding population of wild horses in the Calico herd management areas, that they believed the range could adequately support the number of wild horses. The idea seems to be to exaggerate the number of wild horses to justify removal of more and more of them until there are no more?
BLM would like everyone to believe the agency is just reallybad at counting wild horses. According to Cindy MacDonald at American Herds, BLM is also claiming "hundreds and hundreds of wild horses moved outside the [herd management areas] when the choppers arrived in 2004-2005 - but after the choppers left, the mustangs snuck back inside", thus accounting for the population increases.
It is highly questionable that these horses, however many there are, should have been declared "excess", meaning BLM determines there are too many for the range to support and they must then be removed under the WFRHBA. BLM specialists tasked with monitoring wild horses in this area didn't seem to think as of the spring, 2009, there was any reason to remove wild horses; these specialists actually testified that the range could support the numbers of wild horses.
Also, the environmental assessment for the Calico removal was a sham. Anyone could see very dated studies of the range condition were used. And, your administration would have the public believe that wild horses too few to bother monitoring as of 2008 somehow destroyed the range but thousands of cattle and oil and gas development had nothing to do with it? Just like for the Pryor Mountain, Caliente and Seamen/White River roundups in 2009 where BLM claimed without any current assessment or real proof that the range was degraded because of the horses and never mentioned the tens or even hundreds of thousands of cattle and even sheep also occupying those areas that trample the land and foul the water.
In all of those cases, wildlife ecologists and other witnesses offered substantial proof there was no real evidence of degradation of the range and a dwindling number of horses, not an overpopulation. Regardless, rounding up wildlife and putting them in holding facilities is hardly an ecologically sound method of conservation or preservation.
What about the law?
And what of the law, the requirement that the BLM "shall maintain a current inventory of wild free-roaming horses and burros... to... make determinations as to whether and where an overpopulation exists and whether action should be taken to remove excess animals; determine appropriate management levels [AMLs] of wild free-roaming horses and burros on these areas of the public lands" §1333(b)?
Does it matter at all that the BLM's wildly fluctuating census, obviously made up, and unsubstantiated or outdated claims of "range degradation" violate the law?
By the way, Mr. President, we have seen no evidence of starving horses. Instead, we have seen horses killed, injured and terrified by helicopters BLM uses to run them down and corral them, their families destroyed, their anguish, suffering and fear.
How do you and your DOI and BLM simply ignore the mandate against inhumane treatment of wild horses under the WFRHBA?
Why have you not stopped your administration's disregard of the law, called for the Justice Dept. to investigate and prosecute criminal violations of WFRHBA?
BLM has also basically thumbed its bureaucratic nose at the National Environmental Policy Act, The BLM is required by National Environmental Policy Act ("NEPA"), 42 U.S.C. §§ 4321, et seq., to prepare Environmental Assessments or EAs or, if indicated, Environmental Impact Statements (EIS) or Finding of No Significant Impact (FONSI), for any proposed changes to public lands that may have a significant environmental impact. The law directs the agency to identify environmental concerns, consider alternatives including no action at all and take a "hard look" at the problem and minimize significant environmental impact. A significant environmental impact includes actions that are likely to be highly controversial or have uncertain effects on the quality of our lives and that affect cultural and historical resources. 40 C.F.R. §1508.27(b).
These evaluations as well as land use plans are full of words but have little substance when it comes to stating why wild horses must be removed from their homes. They are all cookie cutter, cut and paste, blaming the wild horses and burros for unspecified "range degradation" without mention of thousands of livestock or other wild animals that share these areas.
BLM's plan for non-excess horses and presumably for healthy unadoptable excess horses is what Ginger Kathrens, founder of Cloud Foundation, has decried as "managing the wild horses to extinction". Secy Salazar's plan, again, not the "change" we were promised, calls for aggressive sterilization and creation of herds that are all geldings or all mares or not in sufficient gender ratios or numbers to maintain genetic viability. Those left after these Frankenstein-like machinations will be placed in those Midwest or East Coast pastures. Forget pastures. The BLM team thought feedlots would be sufficient.
How is that maintaining free roaming behavior as required by WFRHBA? Even BLM agrees herd behavior would be "out the window".
It is evident that BLM's preference for the horses it has captured is to kill them or send them to slaughter. Is that really the long term plan for these horses? During the Calico roundup, for example, no one seems to be keeping track of the horses, many have not been freeze branded as required by law. The BLM is strictly controlling access by the public, treating us as if we are terrorists instead of citizens trying to protect our animals and uphold the laws we passed to protect them.
During its Bush era discussions BLM considered ways to keep the public away from round ups and the killing and sales of healthy horses and burros and planned to brand protests as "eco-terrorism". This was all to be done in secret. Unless you step up and stop this rogue agency, Mr. President, it looks like BLM's plan may succeed.
BLM, for example, has long ignored the limitations on the "multiple use" concept under the WFRHBA and Federal Lands Policy Management Act. BLM issued a regulation that effectively rewrites WFRHBA to say the "objectives of these regulations are management of wild horses and burros as an integral part of the natural system of the public lands under the principle of multiple use". 43 CFR § 4700.0-2 Yet, the WFRHBA says only that wild horses and burros "are to be considered in the area where presently found, as an integral part of the natural system of the public lands". 16 U.S.C. §1331.
WFRHBA mandates "[a]ll management activities shall be at the minimal feasible level". 16 U.S.C. §1333 BLM's regulation says "[m]anagement shall be at the minimum level necessary to attain the objectives identified in approved land use plans and herd management area plans." 43 CFR 4710.4. Two very different laws.
FLPMA makes clear that the protections under WFRHBA take precedence. FLPMA, 43 U.S.C. § 1732 (a) Yet, despite this, BLM has issued a regulation that provides "[w]ild horses and burros shall be considered comparably with other resource values in the formulation of land use plans." 43 C.F.R. §4700.0-6(b).
Indeed, BLM has not managed herd areas as required by WFRHBA only to "maintain a thriving natural ecological balance on the public lands" and "protect the natural ecological balance of all wildlife species which inhabit such lands, particularly endangered wildlife species", or to "protect the range from the deterioration associated with overpopulation". BLM has also ignored the law requiring ranges to be "devoted principally" to use by wild horses/burros. Instead, BLM has used a "multiple use" approach under which the wild horses are generally treated as nuisances to be removed from their own herd areas and ranges.
The BLM has authorized itself to divide herd areas into "herd management areas", something not authorized by WFRHBA. 43 CFR 4710.3-1. In this way, with no statutory authority at all, BLM has limited wild horses and burros' access to thousands of acres that were historically their herd areas. This is done without thought about the horses' seasonal migration patterns or available resources. The BLM then removes wild horses and burros from the artificially created "herd management areas" on the basis there is insufficient forage, water or habitat! BLM also targets them for removal if they cross the artificial boundaries into their original herd areas. What you can do, Mr. President
Mr. President, you can stop the roundups, the cruelty, and you can do it now. Put a moratorium on the roundups, order the Justice Dept to investigate BLM's wild horse and burro program and work with Congress and the public to determine the best course for conserving these animals in their habitat and at the same time meeting the country's energy needs.
