Secy. Vilsack - USDA Cannot Enforce Horse Slaughter Laws

USDA/FSIS Cannot Meet the Legal Requirements for the Return of Horse Slaughter to the U.S.

Dear Secretary of Agriculture Tom Vilsack:

The Food Safety Inspection Service (FSIS) Administrator, Alfred Almanza, has been quoted as saying that the agency is moving quickly to accommodate two pending applications to open horse slaughter plants in the U.S. Though as I understand since then, the applicant in New Mexico has withdrawn the application, and the Missouri applicant is beset with legal problems and was apparently not even the owner of the property proposed for the horse slaughter facility and cannot acquire any ownership interest.

Regardless, a horse slaughter proponent is circulating a "petition" to urge FSIS to move more quickly in approving applications and make inspectors available for horse slaughter for human consumption. The USDA has a number of legal obligations when it comes to slaughtering equines for human consumption; USDA cannot meet any of these obligations and for this and economic, environmental and other health and safety reasons, should not allow horse slaughter.

Substantial Taxpayer Costs with No Economic Benefit

As the U.S. struggles to climb out of the most devastating economic recession since the Great Depression, it is puzzling why FSIS would take funds from an already depleted budget to use for a program to inspect horses to be slaughtered for human consumption. Surely, the threats to food safety and humane treatment of animals are already significant with a reduced budget. Why would any funds be used for a program that results in no economic benefit to the U.S. and instead threatens the health and safety of our local communities and equines?

Prior to the closure of the 3 horse slaughter plants in 2007, FSIS spent approximately $5,000,000 annually for inspectors, basically subsidizing the three foreign-owned (Belgian and French) horse slaughterhouses. Americans don't eat equines so there were no sales of horsemeat domestically and thus no sales tax revenues from slaughter. Horse slaughter facilities pay virtually no income taxes. One facility operating in Texas prior to 2007 paid $5 in federal income tax one year on $12 million dollars in sales. In the preceding 5 years the federal income tax was .3% or 1/3 of 1% of gross revenues or sales. A forensic analysis of the tax returns revealed that the company avoided U.S. income taxes by selling the horsemeat at a loss to an entity it owned in another country and then that entity distributed the product overseas at substantial profit. With no sales or distribution in the U.S. and no tax revenue, there is simply no benefit to the U.S. economy from horse slaughter.

The property tax revenue to Kaufman, Texas where a horse slaughter facility operated until 2007 was generally less than $2,000 per year, a mere pittance when compared to the city's costs for pursuing the facility's continual violations of its wastewater permit and in working to address violations of regulations of Texas Dept. of Health and the Commission on Environmental Quality. The city's legal fees just to address issues related to the horse slaughter plant exceeded its entire budget for legal fees in one year. The city was even fined by the TCEQ for the plant's failure to comply with backflow regulations that meant horse blood and waste backed up into sinks, toilets and tubs. When the plant finally closed, the city was left with nearly $100,000 in unpaid fines for wastewater permit violations.

The situation was no different at the horse slaughter plant in Ft. Worth and the other in DeKalb, Illinois. In DeKalb, the horse slaughter facility had waste permits that allowed contamination levels for waste water that were eight times higher than usual. Yet, the facility was out of compliance hundreds of times. It was not a matter of having old facilities. The owner, Cavel International, built a state-of-the-art pre-treatment system that became operational in 2004. The facility remained out of compliance with its permit regularly until it finally closed in 2007. The blood and waste from slaughtered horses oozed from the state of the art tanks. There were also hundreds of FSIS violations.

The same was true of Canadian Natural Valley Farms where a 2008 investigation revealed the state of the art waste pre-treatment facility overflowed as well with blood and waste, and large amounts of waste and blood were dumped into nearby rivers. When the state of the art facility was shut down, the community was left with environmental contamination and a bankrupt company that claimed $42 million in losses.

None of this includes the plummeting property values, loss of new business, increased crime rates and a general stench and pall that hung over the communities. All courtesy of the horse slaughter plant. This is what President Obama's USDA wants for American communities?

If horse slaughterhouses are allowed to re-open, they would again be subsidized by American taxpayers. Estimates are that the U.S. government would spend at least $3,000,000-5,000,000 annually to subsidize private horse slaughter facilities.

On top of that, the USDA could give foreign owners of U.S. horse slaughter facilities, such as Bouvry, the Canadian company that has explored the possibility of opening a horse slaughter plant near Stanwood, Washington, or the Belgian company, Chevideco, which claims it may contribute to the building of a horse slaughter house in Oregon or Missouri, a subsidized loan of $750,000 through the RUS World Utilities Services.

Mr. Vilsack, it is outrageous that the American taxpayer should support wealthy investors in a business that profits from animal cruelty, benefits only foreign interests and wrecks the U.S. communities where the facilities are located. This money would surely be much better spent on American interests. It would seem more appropriate for USDA to focus on the live horse industry worth $112.1 billion of gross domestic product.

Few Low Wage Jobs

The argument that significant jobs would be created is specious. Horse slaughter plants operating until 2007 never created more than 178 low wage jobs -and many of these were held by illegal aliens. When horse slaughter plants operated in the U.S., this meant workers and their families overran local resources like the hospitals and government services. It meant low income housing and a decline in the overall standard of living.

Slaughter Contributes to Numbers of Horses in Need

Slaughter proponents have widely claimed that slaughter is somehow an alternative for "unwanted" horses. Nothing could be further from the truth. Slaughter actually creates a salvage or secondary market that enables overbreeding and poor breeding practices. Slaughter and a poor economy have resulted in horses in need. Slaughter is driven by a demand for horsemeat in some foreign countries; it is not a "service" for unwanted horses and that is why, as one of your department's own studies confirms, most horses, 92.3%, are healthy when they are sent to slaughter. Kill buyers are interested in buying the healthiest horses for horsemeat that is sold as a delicacy in some foreign countries.

The rise in numbers of horses in need and drop in horse prices is a result of the worst recession in memory. In fact, if slaughter controlled numbers of horses in need, there would be none as slaughter is still available and horses are sent to slaughter in the same numbers as before the 2007 closings of the slaughterhouses that were located in the U.S. It is the availability of slaughter that actually increases the numbers of excess horses and other equines on the market. Banning slaughter would reduce the number of excess horses and other equines.

Also, slaughter accounts for only about 3 cents for every $100 of the equine industry. It makes no sense for anyone to suggest a limited salvage market could influence prices in the entire horse industry.

The Live Horse Industry

Again, it is the live horse industry that USDA should support. Most horses end up at slaughter because they are purchased by kill buyers. Many horses could have easily been purchased by someone else other options include adoption programs, placing them as pasture mates/babysitters to a younger horse, donating them for use in horse therapy, or placing them in a retirement home.

Humane Euthanasia is Available and Affordable

Also, about 900,000 horses are humanely euthanized in the U.S. each year. The infrastructure could easily absorb those sent to slaughter. The average cost of humane euthanasia including the farm call and either burial, rendering or placement in a landfill can be as little as $50 depending on the method used, and at most $400.

Humane Methods of Slaughter Act Unenforceable for Equines

The USDA is responsible for enforcement of the Humane Methods of Slaughter Act, 7 USC Sec. 1902(a)("HMSA"). USDA/FSIS failed miserably at this when horse slaughter was legal. That is because the slaughter of horses and other equines simply cannot be made humane: Dr. Lester Friedlander, DVM & former Chief USDA Inspector, told Congress in 2008 that the captive bolt used to slaughter horses is simply not effective. Horses and other equines, in particular, are very sensitive about anything coming towards their heads and cannot be restrained as required for effective stunning. Dr. Friedlander stated, "These animals regain consciousness 30 seconds after being struck, they are fully aware they are being vivisected." The Government Accountability Office ("GAO") in 2004, GAO-04-247; and dozens of veterinarians and other witnesses have confirmed that ineffective stunning is common and animals are conscious during slaughter. It is simply not possible for USDA/FSIS to make equine slaughter humane and it is a myth to pretend otherwise. Also, the GAO in 3 subsequent reports in 2008, GAO-08-686T; and 2010, GAO-10-203 and GAO-10-487T, has continued to find disparities and inconsistencies in FSIS enforcement of HMSA, an abysmal record of tolerating cruelty at slaughter facilities.

Having to provide sufficient FSIS inspectors even to try to enforce HMSA means even more cost to the taxpayer. For a job that cannot be done when it comes to equines.

Commercial Transportation of Equines to Slaughter Act Unenforceable

GAO has also confirmed that USDA/APHIS has not - and cannot - enforce transport regulations for equines sent to slaughter. 9 CFR Sections 88.1-88.6. Changing a few words here and there in the regulations will not make transport of equines to slaughter humane. USDA/APHIS allows the kill buyers and haulers to fill out and provide the documentation - which is routinely missing, incomplete or inaccurate - relied on for enforcement. It is impossible to enforce regulations when the information to determine violations is supplied solely by the kill buyers and haulers, the very people USDA/APHIS is supposed to be regulating.

A 2010 Office of Inspector General report confirmed APHIS lacks the resources and controls to enforce regulations for humane transport of equines to slaughter. Not only is the information relied on for enforcement supplied by the kill buyers and haulers, APHIS continues to approve of new shipments to slaughter by kill buyers or haulers that have outstanding unpaid fines for violations of humane regulations. The current regulations do not give APHIS the authority to refuse approval.

OIG also found there is no adequate system for tracking the information, such as it is, that is supplied by the kill buyers and haulers about the horses. It is very difficult to track what happens to the horses, meaning enforcement is virtually non-existent. Also, APHIS often does not receive any information from kill buyers or haulers. OIG noted in 2011 that for the past year or more, APHIS had not received the required paperwork, owner/shipper certificates, from kill buyers or haulers for any horses sent from Texas to Mexico.

On top of that, APHIS only has two agents to try to enforce these regulations. Your agency is hamstrung by its own regulations and cannot assure humane transport of equines to slaughter. There is every reason to think your agency could not even begin to assure humane transport of horses within the U.S. to newly opened slaughter facilities.

Food Safety

The Food and Drug Administration ("FDA") does not regulate equines as food animals. Americans don't eat horses and other equines. American horses are not raised, fed and medicated within the FDA guidelines established for food animals, making them unfit and unsafe for human consumption. Equines are given all manner of drugs, steroids, de-wormers and ointments throughout their lives. Equines are not tracked and typically may have several owners. There is no way to know when they are sold for slaughter what these animals have ingested over their lives.

The danger of American horsemeat to consumers was confirmed in a study, "Association of Phenylbutazone (Bute) Usage with Horses Bought for Slaughter" that was published in Food and Chemical Toxicology and authored by Dr. Ann Marini, Department of Neurology, Uniformed University of the Health Sciences; Nicolas Dodman, DVM, Tufts University, and Dr. Nicolas Blondeau, The Institute of Molecular and Cellular Pharmacology.

A kill buyer has no idea of the veterinary or drug history of a horse or other equine taken to slaughter, and many of the most dangerous drugs have no or a very long withdrawal period. A typical drug given routinely to equines like aspirin, phenylbutazone or Bute, is a carcinogen and can also cause aplastic anemia in humans. It has no withdrawal period. The FDA bans bute in all food producing animals because of this serious danger to human health. The FDA and USDA would prohibit Americans from consuming horses because of this danger. Yet, neither the FDA nor the USDA prohibits the export of American horses for slaughter for human consumption. It is a grave risk to public health to continue to allow the export of American horses for slaughter for human consumption in other countries.

The European Union has recognized this and has initiated steps to try to stop the import into the EU of meat from American horses that may be contaminated. Kill buyers have been found to falsify veterinary and drug reports to avoid the restrictions. There is no enforcement at the borders, meaning the US continues to dump contaminated and deadly horsemeat on Europe and other countries. A petition has been filed with the USDA to stop the slaughter of many U.S. horses for this reason.

Conclusion

Mr. Vilsack, in view of all of this, why would the Obama administration allow, let alone facilitate as a priority, the opening of horse slaughter facilities in the U.S.? I would urge the administration to reconsider this and instead work with horse owners, animal welfare organizations, the 80% of Americans who want horse slaughter banned, and end this grisly practice once and for all. Equines are in danger and equine welfare is threatened as long as slaughter remains available.

Horses are NOT for consumption. They have been a part of our evolution for THOUSANDS of years, carrying us on horseback, pulling our carriages and plows for crops. We would not be where we are as a civilization without them – that alone should be enough cause for us to respect them enough not to eat them. Honor our history. Now, horses are a part of another form of transportation. They are our partners in personal and leadership development, they take us to the depths of our psyche and gracefully show us how to be better humans. Read the work of Dr. Allan Hamilton, a neurosurgeon who eloquently describes the science between the horse and human interaction, and how merely being around them – in their presence increases our brain function. They are also used in therapy for the mentally and physically handicapped. Have you ever seen an autistic child get on the back of a horse? Their faces light up with joy and their expression defines the very connection they have with that sentient being at that moment. People suffering from muscular dystrophy go through physical therapy on the back of the horse, because of the way they move simulates the way our hips move when we walk. The millions of reasons why this law should be overturned are details, a story. The true reason is in your heart. Could you really eat a horse? In the USA there is no differentiation between FPA (Food Producing Animal) and non-FPA equidae; horses are simply not considered as part of the food chain. US' horses are slaughtered in Canada and Mexico (and perhaps in the USA re-starting in 2012). Horse meat is exported primarily to Europe (France, Belgium, Italy and Germany are the main horse-meat eating countries). The significant point here is therefore that any horse, not being considered part of the food chain, can be treated with any and all drugs which the vet - or indeed simply the owner - considers necessary, with no formal requirements to observe or fulfil.

The European Union, quite rightly severe (although in our opinion not sufficiently) with its own producers, from whom it demands a strict record of all drugs administered to animals destined for human consumption in the name of the health and safety of the consumer, accepts a mere declaration by the owner of the horse that no drug which is inadmissible in Europe has been administered to the animal, or that due time has elapsed between the administration of drugs, and slaughter. This document should also contain all the necessary information for identification of the equine.

Volunteers from the Equine Welfare Alliance (an alliance of animal rights associations, with members in 18 countries among which Italy, represented by IHP) travelled to New Holland in Pennsylvania, USA to a market for horses destined for slaughter in Canada, to see just how these declarations worked. The volunteers photographed as many declarations as they could manage to get their hands on for a moment: they were all actually blank with just a signature and then just stuck onto any horse, indiscriminately. In one case, there are two pages, one with just a signature and no further details about the horse, the other a blank piece of paper with the name and address of the vendor, plus a comment on how strong and healthy the horse is, and the phrase ‘no drugs'. The practice begs the question, even if the forms were filled in correctly, as to what guarantee there is that the vendor is telling the truth? The Equine Welfare Alliance immediately sent their photos to the competent authority in the EU but has to date received no reply.

Given the situation, some university researchers (Nicholas Dodman, Tufts University, Cummings School of Veterinary Medicine, Massachussets; Nicolas Blondeau University of NIce “Sophia Antipolis”, Institute of Molecular and Cellular Pharmacology , France, and Ann M. Marini, University of Bethesda, Department of Neurology, Maryland) put to the test a theory, cross checking the data of some of the animals sent for slaughter with the data banks from racecourses where the horses had run. Those data bases contain the records, required by anti-doping laws, of treatments with phenylbutazone (commercial name: Bute), a non-steroid anti-inflammatory drug commonly used on horses but which is prohibited in Europe for horses destined for human consumption.

By means of a complex procedure, the researchers uncovered information about the data of races of 16 horses out of 50 of those under study. The result of the study is that all the horses whose data was located had been treated with Bute, some of them only one week before slaughter. However the data uncovered was relative to race dates, while not all treatments administered are logged if they are not close to the date of a race. Horse meat exported to Europe, therefore, is very likely indeed to contain traces of prohibited substances, and not only of fenilbutazone.

After having read the results of this research, we looked further and found a shocking list of drugs and hormones, in every day use on horses in America but severely restricted (or indeed actually prohibited) in Europe because they are dangerous, some very dangerous, to human health. Some hormones permitted in the USA but prohibited, or at any rate strictly regulated in the EU, can be considered so dangerous that some transatlantic health organisations advise, for example: "It is recommended that pregnant women do not handle this product and that the person carrying the container for the oral administration of the product should wear at least two pairs of disposable gloves and be assisted by someone who can open the doors for them, in order to avoid the risk of contamination”.

Digging even deeper we came across something that we would never have wanted to find. Two inspection reports of the EU dated autumn 2010, one in Canada, one in Mexico, following an EU inspection to ensure that horse meat produced there reached an acceptable standard for European public health.

The results of the two inspections are chilling: two slaughter houses in Mexico are completely inadequate, yet anyhow authorised to export meat to the EU. The Mexican authorities “promised” the inspectors that they will not issue export certificates for meat from those two abattoirs. Other slaughter houses “ONLY” had the problem of non-drinkable water, hygiene issues, and, naturally, no check on the veracity of the certificates about drugs. The inspection concluded that the slaughter houses, even though authorised to export to Europe, are not in line with the set standards. Imports to date have not ceased. The situation in Canada is slightly better but even there, apart from some hygiene problems there is absolutely no check on the presence of drugs, apart from the ridiculously inadequate declaration of the vendor.

This situation is not only very serious from the point of view of public health, due to the amount of dangerous or very dangerous drugs the consumer is ingesting, but is it totally scandalous, if we think that the authorities who are supposed to watch over these things are perfectly aware of what has been going on since autumn 2010, quite likely even earlier, and who not only have photographs showing how the ‘certificates' are produced, but also have the word of their very own inspectors, who declare in writing that there can be no guarantee for the public health.

As if this was not enough , it is a common myth in some Countries that horse meat should be given often to children and pregnant women, and to cure anaemia. In other words to all those who should be the object of increased health protection. Health protection that the EU fails to give.

TCEQ Cites Company For Dumping Dead Horses On Rriver Bed






Yet another reason for ending this cruel and dishonest business for good.

PRESIDIO -- KVUE News has a follow-up to a story on the horse export pens on the border.
Horses in this country headed to slaughter in Mexico are held in livestock pens in this tiny West Texas town before they cross the border. A recent report revealed allegations of abuse and neglect at one facility. Now, the Texas Environmental Agency has cited that same company for illegally dumping dead horses along a river bed.

KVUE News has obtained video shot by investigators with the Texas Commission on Environmental Quality. They flew over the export pens in a DPS helicopter after complaints this summer about dead horses dumped in a dry river bed.

"The smell is horrendous," said Amber Taylor, who works with a horse rescue group in Virginia.  She shot her own video of the illegal dumping site.  Taylor came to Presidio to document allegations of abuse and neglect of horses kept in the Texas export pens before they’re sent to slaughter in Mexico.

"You can just look up where these horses are and see the buzzards flying around," she said.
Taylor said she saw dying and dead horses at the export pens leased by the C-4 Cattle Company.
"I have to believe there are so many more," she said.

Environmental investigators also videotaped a path they discovered at the illegal dump site. It lead straight to the C-4 export pens.

The investigation details four serious violations. Most focus on the C-4’s failure to document the number of horses that died at the facility, the cause of death, and proof that the animals were disposed of at an authorized dump site.

In an e-mail, the owner of  C-4 said his lawyer would appeal the decision to cite his business.  The environmental agency has not imposed a penalty yet.

The company faces up to $10,000  a day per violation.

Undercover Investigation Underscores USDA - Documented Brutality

I doubt anyone is surprised at the outcome of this investigation - not even the pro-slaughter lairs who insist we reopen domestic "regulated" horse slaughter plants for the good of the horses. As I know from personal experience in Texas the US plants were no better than the ones in Canada and the EU certified ones in Mexico.

After mountains of evidence just like this anyone who says they believe horse slaughter is "humane" or "euthanasia" is either in deep denial or is a lying SOB who should be tarred and feathered. This abuse is REAL and UNACCEPTABLE.

A thirty month long investigation into the plight of horses who have been sold for slaughter has revealed the worst levels of inhumane treatment. The abuse and neglect of these horses, sometimes referred to as 'kill horses,' was uncovered during the investigation and is consistent with findings and photographs contained in a 906 page document released by the USDA last year.

The investigation and report by Animals' Angels, a Maryland based animal welfare organization, confirmed that injuries and inhumane treatment documented by the U.S. Department of Agriculture during 2005 continue.

Both USDA and Animals' Angels (AA) documents show horses severely injured, left medically untreated, ill, trampled to death and worse on their way to and at slaughter.

Executive Director of Animals' Angels, Sonja Meadows said their investigations quickly revealed that, "Both government records and our report show that being on U.S. soil was not then and is not now the slightest guarantee of humane treatment."

The slaughter of horses in the U.S., which stopped with plant closures in 2007, continues in Canada and Mexico. Groups advocating the slaughter of American horses have called for the reopening of U.S. horse slaughter plants, saying horses are better protected by U.S. humane laws than by laws in Canada and Mexico. However, during the 30 month long investigation that included repeated visits to auctions, feedlots and slaughter plants, AA investigators concluded abuse and inhumane treatment are inherent to the horse slaughter industry.

"It takes inhumane treatment to make the economics work," said Meadows. "We found the cruelty starts well before horses arrive at the slaughter plant."

The AA report documents available veterinary care withheld from horses severely injured or near death. Undercover investigators were routinely told, 'That horse is going to slaughter anyway,' or the horses were 'just passing through.'

Treatment of horses designated for slaughter ranged from beating horses and jabbing them in the eyes, to using a cable winch to drag downed horses with a wire wrapped around a back leg.

Investigators observed horses being injured or killed after being forced into dangerously crowded pens where they were kicked or trampled. Others were found frozen to the ground after overnight temperatures dropped well below freezing.

Young and small horses, as well as horses injured or weak were trampled to death in trailers crowded with 40 horses. Workers failed to separate stallions, ensuring fierce fighting in close quarters during transport.

Making conditions worse is the issue of stolen horses, according to Debi Metcalfe, founder of Stolen Horse International, Inc., which operates http://www.NetPosse.com, a horse theft recovery network that averages 80,000 unique visitors per month. "We have dealt with cases where horses were stolen," said Metcalf. "We later found out that these innocent pets had been slaughtered."

Investigators also discovered at both Canadian and Mexican slaughter plants horses left in bloody 'kill boxes,' used to restrain horses as they are being killed, during lunch breaks. According to the report, the horses were 'shaking violently as if they might fall down.' Plant management told investigators the horses 'aren't bothered by it.'

AA investigators documented injured and dead horses at every stop along the horse slaughter pipeline. At feedlots and export pens horses had no food and water troughs were empty. An export facility veterinarian informed investigators horses too weak for transport would be left behind to die in the pens.

"The public has been duped into thinking horse slaughter has ended, but it just moved a few hours further down the road," Meadows pointed out. "It hasn't somehow changed into something it is not. It is the same terrible suffering it was in 2005."

"By the time the horse finally stands in the kill box at the slaughter plant, it is often not the worst thing that has happened to it since this dreadful journey began," said Meadows.

Belgian and Dutch consumers were shocked to learn of widespread horse slaughter-related cruelty in North and South America. Undercover video footage aired on three major news programs showed horses designated for slaughter are routinely starved, dehydrated, injured and abused.

Horse meat is commonly available in Belgium and the Netherlands where consumers are almost completely unaware of the cruelties of horse slaughter. Most believe what suppliers claim on their websites, that the meat on their dinner plate comes from contented, grass-eating, healthy horses. The story begins by asking, "Do they [consumers] really know where it comes from?

plantThe 8½ minute news segment was produced by GAIA, a respected animal welfare organization from Belgium, with much of the footage provided by Animals' Angels USA. The dire conditions of horses at slaughter plants, feedlots and markets in Mexico, Brazil and the U.S., have generated talk of boycotts and moratoriums on the import of horse meat from these countries.
Viewers are told "Cruelty goes hand in hand with incompetence", as undercover video shows a worker knowingly crushing the lower leg of a live horse as he forces the iron gate of an overcrowded trailer shut.

Consumers responding on television websites demanded action. "They [importers] told us the meat is of superior quality because the animals live a life of luxury and freedom on green pastures...well cared for with plenty of food. But it's a horrible lie."

On importer Chevideco's website, horses are said to be treated with respect horse at slaughter plantand to live without stress. An accompanying photograph depicts well-proportioned horses standing knee deep in grass. Importer such as Visser & van Walsum make similar claims.
 
Within hours of the story's broadcast, supermarkets responded with promises to investigate. Delhaize, the second largest retailer in Belgium asked their supplier to remove affected meat from their shelves. Two other major grocers have told consumers they do not import horse meat from outside Europe.

Fenavian, the Federation of Meat Producers in Belgium, issued a response denying any wrongdoing and offering reassurances that adherence to safety and European Union animal welfare rules were standard practice.

"However, the evidence is quite overwhelming," said Sonja Meadows, president of Animals Angels U.S.  "Up until recently, officials may have been able to claim that to their knowledge, the animals were treated properly. But now such claims are quite obviously false. Unfortunately we have plenty of documentation to prove that animals caught up in the horse slaughter pipeline are horribly abused."

Dead horse BeltexAnimals' Angels' began focusing efforts on the issue of European consumers' awareness about horse slaughter in November 2009 after meeting with the European Commission. AA shared with committee members evidence of extreme cruelty uncovered at Mexican horse slaughter plants, U.S. feedlots and government export facilities. AA filed an official complaint with the commission soon after the meeting.

Last month Gaia asked Animals' Angels for footage from Mexico and the U.S. to help with a European campaign to publicize the conditions endured by horses in the slaughter pipeline. Gaia had recently finished undercover investigations in South America and had gathered their own ample evidence of brutality.

Other organizations in the Netherlands and France are also launching consumer awareness campaigns. Most national and regional newspapers have published the story and photographs. Fueled by concerns from both consumers and animal welfare advocates, many more European news outlets are expected to pick up the story.

"I really doubt I'll ever eat horse meat again," said one man. "They may say they fixed the problem, but I'll never trust them again."

The following are selected responses about the transport of horses from the U.S. and the slaughter of horses in Canada from interviews between CBC News reporter Mellissa Fung and Twyla Francois (TF), Regional Director of the Canadian Horse Defense Coalition.

ABOUT BREEDING HORSES AND THE MARKET FOR HORSE MEAT

TF: I think one of the big problems – what I was finding in the feedlots in the States and in Canada – we have a number of them here in Canada and there’s one just down the road from me in Manitoba – they’re breeding (horses) as well, and so there’s this indiscriminate breeding that’s going on. Even with the racehorse industry, they breed hoping for that one-in-a-million horse and all these others end up as surplus. So I think that if there was no more market, if horsemeat becomes illegal and you can’t slaughter them anymore or the market dries up in Europe, because that’s where most of it is going – is France, and Japan, actually, then the industry would have to react. If there’s no market, they’ll just stop all this indiscriminate breeding, because then suddenly there won’t be a dollar value to it.

THE WAY HORSES ARE KILLED

TF: There are only two ways to legally kill a horse in Canada - with a .22 or with a captive bolt pistol. A .22 is much more humane than a captive bolt pistol, because the problem with horses is that they’re very head shy. So when you try to put anything near their head, they’re going to flinch, they’re going to move around. Whereas a .22, it can be aimed at a bit of a distance and it’s a quick, penetrating bolt and they’re gone. But with a captive bolt, it seems that it requires more learning. A captive bolt pistol is a contraption that’s held against a head and a metal bolt comes out, and retracts. And it causes enough damage to the brain that an animal is rendered unconscious quickly. And I have seen it done and it does work, but the difficulty is with horses, they’re head shy. So if you try to put anything near their head, they’re going flinch, they’re going to move, they’re not like a cow. So what we’re wondering is – (when we see dead) horses who don’t have captive boltholes, could they be the ones where the bolt missed? Is it hitting them elsewhere in their face? Is there pressure to continue the line because they’re killing 200 horses a day, which is a massive number of such a large animal, and it takes a long time to process these bodies? So could there be so much pressure that even though they’re not being rendered unconscious, that they’re just pushing them through the line? Bleeding them out while they’re still conscious? We honestly don’t know and the implications are really, really frightening. There’s one method of slaughter that’s being done in Mexico that’s called puntilla, and this is where they use an ice pick and they jab it in the back of the spinal cord. And it doesn’t stop pain. It doesn’t render them unconscious. It just immobilizes them. And I hope this isn’t being used here, but we really have no idea what is being done with these horses.

WHEN THE HORSES SENT TO SLAUGHTER ARE EX-PETS

TF: One of the big issues with horses specifically is a lot of these horses have known human companionship. They seek comfort from us, and it is the ultimate betrayal, that after owning an animal for so long – and at the auctions I see a lot of 20+ year horses – they become injured or they require medical treatment and they’re close to death and the owner knows it’s going to cost quite a bit to bury them, then they’re brought to the auction and these animals are so frightened. You can see them in the ring, that they search the ring looking for a friendly face. We have been comfort for them, and then we take them to slaughter. We see this at the slaughterhouses too, where they’re still seeking out affection from even the slaughterhouse workers themselves. I went to some auctions in Colorado and New Mexico and Texas, and through the States and what we found was a lot of these horses are ex-pets. They’re 20 year-old horses that have been in somebody’s backyard, and then they get ill and it becomes expensive to care of them, expensive to bury them…and so they bring them to auction. But they’re not aware of what they’re inflicting on these horses. And one thing we saw that really broke my heart was, you would see the workers walking by the pens and the horses would rush the pens, looking for comfort from these men who were going to kill them. It just seems like such a betrayal. I think just because of the history of the horse and how they are treated, here in North America and what they’ve experienced in their own life, nothing can prepare them for the journey they have ahead of them after they’ve been given up.

THE DIFFERENCE BETWEEN COW AND HORSE SLAUGHTER

TF: There is a large difference because a horse is a flight animal and their immediate response to fear is to run. And this is what we’ve seen with the handling, because if you’re handling cattle, they follow. They just tend to follow one another. They’re quite calm, whereas what we saw with the handling of horses – electric prods are being used. They’re scared, they’re frightened, they’re frantically running one way, and if they come across any kind of barrier, they would all flee back the other way and then they would all whip back over. So it’s just this reaction they have of pure fright. They also are extremely head shy so trying to hit the captive bolt cleanly, to ensure a clean hit, is much more difficult. There’s a much higher risk of having to shoot them multiple times and just that their reaction is very different. They’re a flight animal. The problem is also with the transport issue, that because they’re such a tall animal and we’re still allowing transport on double-deckers – it’s such a grueling, grueling ride for them -15 to 25 hours of not being able to stand upright. It’s a much more difficult ride for a horse.

ABOUT THE REGULATIONS ON HORSE TRANSPORT

TF: The regulations need to be updated. They’re archaic. We’re worse than the United States. Monogastrics like horses and pigs can be transported up to 36 hours with no food or water, and keep in mind that these horses are often coming from the United States, and in the United States, they can be transported up to 28 hours. But the problem is when they hit the border, the clock doesn’t go back to zero - it continues on. So they can literally be doing 50, 60 hours with no food or water or a break.

ON THE ROLE OF THE CANADIAN FOOD INSPECTION AGENCY

TF: There is always the question of a conflict of interest, because part of their mandate is to encourage the consumption of Canadian foods. But yet they’re supposed to be providing this protective role as well, for our health and for the welfare of animals. But we question whether they can really give welfare what is required, because even if we call a CFIA inspector about an animal, they aren’t authorized to euthanize. So we can have this animal that’s suffering very badly, and we call in the federal authority and they can’t even do anything about it.

ON A HUMANE WAY TO SLAUGHTER A HORSE

TF: For horses in particular, the fear in them is really shocking when you see them in the slaughterplants. So (humane slaughter) would involve not actually being transported, because there are so many problems transporting horses. It would be slaughter on farm, with a mobile slaughter unit, it would be the only way you could more humanely kill a horse. Our concern with the slaughter a horse is it can’t be done humanely. The only way to humanely kill a horse would be to put it down on the farm. And so we really don’t believe that slaughtering horses could ever be made humane.

THE RAISING OF AWARENESS

TF: Something I’ve been discovering is, I don’t think people who have horses really know what the slaughter process is about. If they knew that it wasn’t this very quick overnight – killed instantly – they wouldn’t be sending them. And I think this is something we have to do – is a large education campaign. As Canadians are becoming more aware of this issue, we’re getting rescue shelters popping up all over the place. People care about horses and they don’t like to see this happening to them, and if they hear of any case of suffering – and I get these calls every day. People just don’t want to see horses suffer. So people will respond - they’ll donate, shelters will come up.

A Sweeping Undercover Investigation of Canada's Leading Equine Slaughterhouses

Horse Welfare Group calls for immediate closure of Canada's horse slaughter plants

Westbank, B.C., March 30, 2010: In late February 2010, the Canadian Horse Defence Coalition (CHDC) received hidden camera footage of horse slaughter practices at Quebec's Viande Richelieu and Alberta's Bouvry Exports - the latter known as North America's largest exporter of horsemeat. The CHDC has asked a panel of veterinarians, the BC SPCA and the World Society for the Protection of Animals to review the footage, which contains numerous instances of improper stunning and horses showing signs of returning consciousness.

Early audit results of the footage show automatic failures of both facilities. The CHDC has compelling proof that puts into question the effectiveness of the assembly-line slaughter of horses. The evidence demonstrates that both the facilities in Alberta and Quebec fail to meet humane slaughter standards used by the CFIA to audit Canadian slaughterhouses. The CHDC's June 2008 report on Natural Valley Farms - the now bankrupt horse slaughterhouse in Saskatchewan (see story) documented the inadequate stunning of horses with the penetrating captive bolt gun. At both plants in the February 2010 investigation, a .22 rifle was used, and again horses were shot incorrectly, with some regaining consciousness. As stated by Alberta veterinarian Dr. Debi Zimmermann: "I conclude that the wary and flighty nature of the horse, coupled with the poorly designed kill plant systems currently in place at Bouvry Exports and Viande Richelieu, results in unacceptable levels of suffering endured by horses (both in number of horses and degree of suffering), and poses inherent dangers to plant personnel." Dr. Zimmermann adds: "The shooters are seldom able to adhere to the required protocols for euthanasia by firearm, due to a combination of horse and human factors."

As there are only two government-approved methods of stunning horses in Canada - captive bolt gun and rifle - and both methods have been shown to cause prolonged suffering in numerous horses, we conclude that these animals cannot be slaughtered humanely in today's slaughterhouse assembly lines.

The CHDC therefore calls for the immediate closure of Canada's horse slaughter plants.

    Statement from World Society for the Protection of Animals (WSPA)
      The World Society for the Protection of Animals (WSPA) is appalled by evidence of grossly inhumane slaughter of horses taking place in Canada. We have been sent video footage that is stated to have been taken recently in Bouvry Exports Calgary Ltd slaughterhouse in Fort Macleod, Alberta and Viande Richelieu Inc./Richelieu Meat Inc. slaughterhouse in Massueville, Quebec.  It is clear that neither the facilities nor the behaviour of the personnel shown are suited to the humane slaughter of horses, and that extreme suffering results for many individual animals. Problems include failure to restrain each animal's head properly before shooting, shooting from too great a distance, shooting in the wrong part of the head or body, failure to follow up with an immediate second shot in animals that were not killed by the first, hoisting apparently conscious animals, and - in the case of the Richelieu plant - cruel handling and treatment of the horses, including excessive whipping and overuse of an electric prod as well as an apparent callous disregard for the animals' suffering. An additional cause of very major concern is the presence of what appear to be either plant supervisors or inspectors who observe the employees' actions and yet do nothing.  The WSPA calls on the appropriate authorities to take immediate action to close both these plants down and ensure that those responsible are disciplined. Neither plant should be reopened until or unless they have been redesigned to meet humane slaughter standards, and all staff in contact with these intelligent animals have been trained to treat them with the dignity they deserve.  Furthermore, as we understand that these are the two largest of only four slaughter plants federally registered and licensed to export horse meat abroad, the Minister of Agriculture and Agri-Food should revoke their registration as well as any export permits immediately. To ensure that similar problems are not occurring at the two other federally registered horse slaughter plants, the Canadian Food Inspection Agency (CFIA) should commission independent audits of those as soon as possible.  Measures must be taken to ensure that procedures at the slaughterhouse are carried out in accordance with legislation, including the Canadian Meat Inspection Act which requires that all animals should be slaughtered humanely. We understand that slaughter should be overseen by the CFIA. That oversight should guarantee avoidance of practices that inflict extreme pain and suffering on slaughtered animals, such as those witnessed here that affect hundreds of animals. The WSPA would be happy to provide advice on appropriate facilities and training for humane slaughter, if required, to help protect animals from needless suffering.     FOIA Request Uncovers Unprecedented Evidence Horse Slaughter is Inhumane



    Documents never before made public reveal the USDA was aware of extreme cruelty during horse slaughter at facilities in the U.S. The documents dispute claims horse slaughter in the U.S. was in any sense humane and instead reveal a brutal, terrifying ordeal that should be permanently banned.


    Ithaca, New York (PRWEB) December 4, 2008 - The U.S. Department of Agriculture (USDA) has released a 906-page document revealing for the first time the alarming cruelty that takes place during horse slaughter in the U.S. The documents included almost nine hundred photographs. Information was obtained through a Freedom of Information Act request submitted 3 years ago by equine cruelty investigator Julie Caramante. Animals Angels assisted Caramante in obtaining the documents, and they are now working with Animal Law Coalition to assess and disseminate the information.

    "I've been an equine cruelty investigator for a number of years," said Caramante, "and I've witnessed many incidents of animal cruelty but nothing could prepare me for these images."

    The photographs document significant injuries to horses at the slaughter house. Injuries included conscious dismemberment, open fractures, blinding, and battered faces. It appears some horses were left to bleed out. Other injuries indicated long term abuse and neglect.

    'The pain and terror these horses had endured is criminal," said Caramante.

    In July, well before release of the documents, Dr. Nicholas Dodman of the Tufts School of Veterinary Medicine testified before the U.S. House Judiciary Committee describing horse slaughter as, " a brutal and predatory business that promotes cruelty and neglect," concluding that as a veterinarian a "rapid end to this wholly brutal and un-American trade" is warranted.

    Horse slaughter in the U.S. ended in 2007 after the three remaining plants in Texas and Illinois were closed by state lawmakers and the courts. There is a federal bill pending in Congress that would prevent horse slaughter from resuming in states without laws prohibiting it.

    Those in favor of horse slaughter have insisted horse slaughter should resume because they claim U.S. humane laws protect horses from cruelty, unlike Mexico and Canada where American horses are now sent to be slaughtered for human consumption in France, Belgium and some other countries.

    Former Rep. Charlie Stenholm who is now a lobbyist for the horse slaughter plants, has called horse slaughter a safe, convenient way to dispose of horses. He has called it a "well-regulated industry" practicing "humane euthanasia". Stenholm has told the House Judiciary Committee horses are personal property and owners should be able to decide what to do with their property without government intervention.


    Sonja Meadows, executive director of Animals' Angels, said, "We now know [from these new documents] that being on U.S. soil does not make horse slaughter humane or better. That this could go on even with the presence of USDA inspectors makes absolutely clear that horse slaughter is not euthanasia and definitely not a humane end."

    Meadows is hopeful that the shocking evidence of the cruelty of horse slaughter in the USDA document will compel the new Congress to act swiftly to pass a federal ban on the transport and slaughter of American horses. "In 2006 the House voted by a wide margin, 263-146, to ban horse slaughter. But the session ended before the Senate could vote," she said. "Now, this new evidence removes any doubt. We must act quickly. We cannot allow horse slaughter to continue any longer."
