Public “Observation” at Callaghan Complex Wild Horse Roundup

The latest report from Laura Leigh on the Callaghan Complex roundup leaves me speechless. Keep in mind, Laura is the ONLY observer braving the frigid weather to bring us these invaluable reports on OUR wild horses.

To have her drive for four hours - assuring her that she would be told if there were any changes in the protocol - Laura arrived to find - a change in protocol that would make "observation" even more difficult that it had been previously. Which means virtually nonexistent.

I realize the BLM hates Laura because they think SHE is the reason they look so bad. It's not them, folks, it's Laura for reporting it. These cretins are adults - at least in age if not in judgement - and they are acting worse than even the brattiest ten year old.

I plan to send this to my Senators and Representatives. It probably won't do much good, but this childish, vindictive behavior is unacceptable. WE pay these idiots with OUR tax money, and I'm totally, completely FED UP!

I'm afraid to think what their next move might be. I'll bet poor Laura feels like Alice in Wonderland. I know I do.

Public “Observation” at Callaghan Complex Wild Horse Roundup

After braving a 4 hour drive through snow, rain and fog to observe and report back to us from the Callaghan Complex, lone observer Laura Leigh was met with an unexpected change in blm’s protocol regarding where the “public” would be allowed to view the roundup from. Although she was promised that she would be alerted to any changes in blm protocol prior to making the long journey she was not told that the  access to view would be changed from what she had experienced during the prior days.
While the prior access was not good, yesterdays access was almost non existent although a 60X zoom lens helped enough to capture these images for us. 
Why the unexpected change in viewing access ? There were no blm personnel available to speak with her on this concern, either by phone or in person at the location. 
The public counts on these reports from the roundups and we are concerned about this unwarranted and unnecessary change in the viewing arrangement. 
In my opinion, on a level of common decency and keeping an agreement in good faith, the blm personnel should have contacted Laura as they had promised, so that this long journey out the location in inclement weather would not have been taken for naught.
Why the unexpected and arbitrary change in the viewing access for a single, lone observer who is a member of the accredited press ?
On even the most basic level, common decency and keeping agreements………in my opinion the blm sets a pretty low standard, judging by past behavior.

Pictures and Report from Bald Mountain Wild Horse Roundup

I believe the words and pictures in this report speak for themselves. Stampeding the horses during a "freezing fog" event, no shelter for the horses in bitter cold, new equipment including a "cell killer" which probably had nothing whatsoever to do with the fact that every time Laura tried to go live, her cell service would immediately drop out even though it was just fine seconds before. Stinks to high Heaven doesn't it?

Please contact your Senators and Representatives in Washington and ask them if this is their idea of complying with a journalist's 1st Amendment rights. There is nothing so low that these creeps won't stoop to it.

And, get this, Laura was the ONLY observer there!

Pictures and Report from Bald Mountain Wild Horse Roundup

Yesterday’s freezing cold and a fog of legends at Callaghan wild horse roundup was nothing compared to reports of the bitter cold temperatures in Nevada’s Bald Mountain today. 

The legend, >From Wikipedia:
The name pogonip is an English adaptation of the Shoshone word meaning "cloud" (payinappih). The English-speaking settlers who encountered this unpleasant and sometimes scary phenomenon when they went out West in the 1800s needed a word for it and they borrowed it from local populations.

This freezing cold fog has been known to kill animals by freezing their lungs.

Apparently, blm thinks its a great day to stampede America’s wild horses to their capture. 

Here are five photos, taken yesterday by journalist Laura Leigh. She is on the ground at Bald Mountain reporting back to us on the happenings there and the world is watching.

Basing my assumptions on the past actions of this government agency blm, no member of the public would have ever seen these horses. Laura’s pictures are the only testimony to their existence. Thankfully Laura’s courage and fortitude has her witnessing. 

All our attempts to stream live from this location, so far, have resulted in cell service “dropping” immediately as her equipment was set to go live even though it was clear and strong seconds earlier.  New equipment on the government’s blm vehicles, at least those seen in Twin Peaks, had the capability to kill cell service and broadband connections, much the same way as movie theaters do. I can’t help but wonder if Nevada has the same…….and more importantly, why would they need it ?


And since I am asking, why has blm supplied it’s employees with new cameras and new flip videos ? Why would a blm truck need what’s called a “cell killer”, cameras, tracking devices and other types of surveillance equipment ? Why do you suppose………..

Maybe they should have spent the over 62 million dollars in stimulus money they received last year to put the Wild Horse and Burro Program on a sustainable track and not on high tech “toys”.  The word shame does not even begin to describe this scenario.
I am waiting for Laura Leigh’s additional report from today’s roundup activities. I expect to hear from her shortly.

A Note From the Field

This is from Laura Leigh, the advocate GrassRootsHorse is supporting in her ongoing law suit against the BLM and their transgressions against our wild horses.
It has become obvious that the BLM is retaliating against Laura, unbelievable as this may seem. This is only the latest example. There seems to be NO level to which these people will not stoop - and our tax money is paying for it all, including their salaries.
Laura does have a Court date now. On Wednesday, November 17th, she will again be in Judge Hicks court in Reno, arguing for our horses and her - and our - Constitutional rights.
For now, however, she only wants to pick up her beautiful Mustang in peace and fairness. This is YOUR tax money at work.....

RENO, (Horseback) – I have spent literally thousands of hours on the road trying to document the hands-on care of America’s National Treasure, the wild horse by the agency tasked by Congress to manage these beings “humanely.”
My travels have included documenting wild horses on the range, at roundups and holding facilities.
I do this work because I am passionate about the subject. These animals speak to my soul. The convoluted process that has them literally trapped both fascinates and disgusts me.
When I am at roundups, or facilities that house our horses, I may express my opinions but I am never “out-of-line.” I obey rules, no matter how ridiculous.
At the Silver King roundup I was “grabbed” hard by a beautiful Albino stallion. His gaze was riveting. When he shipped we followed him from Pioche, Nevada all the way to Gunnison Prison in Utah.
As I inquired about his adoption, to go to sanctuary with some of the others, I exchanged emails with a woman I met once.
Dona Bastian runs the BLM facility at Gunnison.
In the course of her emails to me she told me I had to make sure to tell them when I was coming to pick up the stallion. She informed me that they needed to notify SWAT.
I’m not kidding.
Here is the email:
I need a application for adoption and also payment before the animals are

picked up. Do you have an approved adoption application? I know you said

you was working on it with John Neil. Also, the pickup is by appointment

only. We have to have a clearance, and also SWAT notified in advance.

A Motion for a Temporary Restraining Order was filed at 5 a.m. PT September 24, 2010 in Nevada. The action was brought by Laura Leigh, photojournalist and videographer who is supported by Grass Roots Horse in this matter.

The motion asks for an immediate cessation of all helicopter roundups and all related activities regarding any and all aspects of any actions related to wild horse movement, gathering or rounding up as well as any actions involving all horses in short or long term holding.

This motion is about accountability, access, and transparency. “This is about the horses, each and every horse. Every individual life that leaves the range matters and is important to the American public. This is not about some bulk inventory and it is about time that the government recognizes that fact. We are not going away. The wild horses and burros are living beings mandated to be managed humanely.” said Maureen VanDerStad of Grass Roots Horse, a nonprofit group based in grass roots activism.

This battle for humane treatment and proper management of the wild horses and burros has been going on for decades and is still going on. It began on a grass roots level when Velma Johnston first sought to stop the killing and abuse of the wild horses and burros six decades ago. That effort resulted in the Free Roaming Wild Horse and Burro Act of 1971, which mandated, among many other things, the humane treatment of these symbols of our American heritage and pioneer spirit. The Bureau of Land Management and the Department of Interior have steadily and secretly chipped away at those mandates and protections over the years resulting in the abominable situation we have now. Anything to do with the wild horse and burro program or the animals themselves, even their location, is shrouded in secrecy and hidden under layers of excessive bureaucracy.

A Complaint seeking Declaratory and Injunctive Relief was filed September 22, 2010 in regard to the proposed Silver King Wild Horse roundup to be conducted in Nevada by the Bureau of Land Management. The action is brought by Laura Leigh, a credentialed photojournalist and videographer who had been among other members of the press who were singled-out during previous wild horse roundups, which the Bureau of Land Management (BLM) euphemistically calls “gathers.”
She was precluded access to areas where other media or press, who were hand-selected by BLM, were permitted unfettered access to observe and to report. In addition, access that would allow press and public to observe the health and well-being of the horses after they were captured was either denied or severely limited.

“Without a free press able to operate as intended by our First Amendment Rights, our system of democracy fails. And it is failing now. This agency (BLM) is doing everything it can to impede the process of informing the public of its actions and all activities. From the necessity to FOIA documents (filing a request for information through Freedom of Information Act) to actual activities on the ground, the BLM goes through tremendous gymnastics to control content of what the public knows and can see. “That’s not democracy, this is something else.” said Plaintiff Laura Leigh.

These recurring actions and conduct by BLM in regard to allowing public access as well as not openly accounting for the handling of the horses from the point of their capture to their ultimate disposition, have been consistent and well documented and are the basis for the complaint filed yesterday, which seeks to ask the court’s help in ensuring it does not happen again, and that a system of transparency and accountability is put in place and enforced. A jury trial has been requested.

The BLM and the Department of Interior published their intent to close public lands for the duration of the Silver King wild horse roundup, and that they would allow only two public observation days, both to be on Tuesdays, throughout the entire three week operation. The Hon. Larry R. Hicks recently ruled that closing public lands during roundup operations and limiting public and press access were prior restraint’s on First Amendment Rights.

“The Press was protected so that it could bare the secrets of the government and inform the people. Only a free and unrestrained press can effectively expose deception in government. And paramount among the responsibilities of a free press is the duty to prevent any part of the government from deceiving the people” Justice Hugo Black, 1971

This legal action is supported by Grass Roots Horse, a nonprofit equine welfare charity with a focus on citizen action and grass roots level involvement. “This legal action has needed to happen for a long time, said Lisa Owen of Grass Roots Horse. “Sunshine is the best disinfectant and the public has every right to ensure the welfare of the wild horses and burros at all times and to demand that accurate records on each and every horse or burro be maintained throughout. The public must have unquestionable assurance that the care and treatment of the wild horses and burros are based with the best interests and welfare of the horses and burros in mind, especially since taxpayers are footing the bill for it. We have more than a vested interest in not only the fate of the wild horses and burros from capture onward, but throughout their lives. It is only fitting that a jury trial has been requested.”

More Litigation Filed to Stop BLM Stampedes – Photos Damning

SAN FRANCISCO, (Grass Roots) - On August 10, 2010, Laura Leigh, filed a Motion For Reconsideration of Denial of Plaintiff‟s Order to Show Cause Re: Contempt brought against Ken Salazar, Secretary of the Department of the Interior, Bob Abbey, Director of the BLM and Ron Wenker, Nevada State Director of the BLM in Nevada District court. The legal actions are supported by Grass Roots Horse, http://grassrootshorse.com/legalactions.htm 
The original Motion on Contempt of Court charges levied against the BLM was denied, but a recent law change made it possible for it to be re-filed under the new standard of law. The Motion filed yesterday cites newly discovered evidence of the Defendant‟s violation of the court‟s previous order to uphold the plaintiff‟s First Amendment Rights to observe and report on the Bureau of Land Management in regard to the “gather” (“gather” is the BLM euphemism for roundups) and removal of wild horses in Owyhee Herd Management Area. The latest filing also addresses the Defendant‟s sworn testimony in open court that a „water emergency‟ existed and that an „emergency‟ roundup had to take place, or horses would die. This testimony resulted in Judge Larry Hicks lifting the Temporary Restraining Order he had put in place to halt the Owyhee gather until he could hear legal arguments in the case.

Contempt of Court Re-filed Against Ken Salazar and BLM

Laura Leigh re-filed Contempt of Court charges against Ken Salazar, Secretary ofthe Department of the Interior, Bob Abbey, Director of the BLM and Ron Wenker, Nevada State Director of the BLM in regard to what BLM calls the “Tuscarora wild horse gather.” The BLM continually refers to the three herd management areas of Owyhee, Rock Creek and Little Humboldt under one umbrella name of Tuscarora. Thejudge, at the time of hearing earlier motions, recognized that Tuscarora was
three herds and not one as BLM would like people to believe.


Adding to what seems like a deliberate move to create confusion, every day the gather schedules change. At present the BLM website, touted in BLM press releases as the only place for correct information, has two completely different gather schedules posted. If a person really wants to know the true schedule they have to contact the appropriatefield offices. It would seem to even the casual observer to be a shell game of now you see it, now you don’t.  



The judge denied the original motion to hear the case based on the parameters set forth in a statute known as the Winters standard. This is the standard by which actions seeking injunctive relief are judged on their merit. On July 28, 2010, the Ninth Circuit Court of Appeals modified its position on the test used to determine the element, “likelihood of success on the merits” when granting or denying injunctive relief under the Winters decision. The circuit court reaffirmed the use of its sliding scale method, finding it consistent with Winters.


The law change opened the door for the re-filing under the new guidelines. “We are not going away,” said Laura Leigh, plaintiff in the lawsuit brought about through the support of Grass Roots Horse, a citizen action group. Support for Laura Leigh’s court action is coming in from people all over the country. “Some people are donating to further the cause with $3.00 donations,” said Maureen VanDerStad, member of Grass Roots Horse. “That tells it all right there. People are so fed up with the mismanagement of the wild horses and burros that they want to be a part of doing something to stop it. The blatant disregard for our First Amendment rights by BLM and the cruel and inhumane treatment of the wild horses, which belong to the American people, has spurred the movement on with a vengeance,” she further states.



Laura Leigh is an artist, author and journalist who is best known for her work in documenting wild horses. She is the founder and director of Herd Watch, a citizen group that monitors the actions of the BLM and the Wild Horse and Burro Program. Full reports documenting range conditions in herd management areas and the condition of the horses themselves are conducted by Herd Watch with a
meticulous eye for detail.




Yesterday at the Nevada State Legislative meeting, the main focus was on the implications of the Western Watershed Organization’s multi-million dollar settlement with Ruby Corporaton, representing Ruby Pipeline. The Wild Horse and Burro Program came into the discussion and Laura Leigh was there to set the record straight. “Sitting in the audience it was really interesting to see the cattlemen bringing up the very same issues of the difficulties of dealing with the BLM that the wild horse advocates have been dealing with for years. If people do not support accountability in government, it is easy to see how that failure to demand accountability and transparency can turn against them,” Laura Leigh said.

Hundreds of young wild horse foals risk death in imminent Nevada roundup

Reno NV (July 9, 2010)—One woman from Herd-Watch, a program of The Cloud Foundation, studied the newly published Bureau of Land Management (BLM) Wild Horse and Burro handbook and caught BLM in the act of violating their own protocol for the Tuscarora (Owyhee Complex) roundup. The handbook states roundups are prohibited until six weeks after foaling season which ends on June 30th. Therefore the earliest date to start the roundup is August 11th. Laura Leigh, Project Manager of Herd Watch filed a lawsuit today in US District Court in Nevada to stop the roundup.

"I found their error right in the BLM's management handbook," explains Leigh adding, "The BLM disregards their own rules when it comes to ‘managing’ wild horse population.”

Based on past experience and the current rush to remove 6,000 wild horses in three months, The Cloud Foundation believes that the BLM's priorities are based on contractor availability not humane treatment of wild horses—especially foals, some of whom may be only weeks or days old.

The Foundation is requesting that humane observers and members of the public be present during all phases of all the roundups. Since the deadly Calico roundup in NW Nevada, BLM has tightened restrictions, preventing the public and humane observers from viewing the horses adequately. In the case of Tuscarora, the public will not be allowed to view any round up activities for the first two weeks.

Ginger Kathrens, Executive Director of The Cloud Foundation, shares Leigh’s concerns that "more foals may have their feet literally run off because they are too young to be chased by helicopter over sharp, volcanic terrain for miles in the hottest month of the year. At least two foals died a horrible death like this in the Calico roundup. Didn’t BLM learn anything from Calico?”   

More than 100 wild horses died and more than 40 spontaneous abortions occurred as a result of the Calico roundup.

“Currently, the only way to gain accountability—with an agency apparently left to police itself—is for a member of the public to file suit,” remarks Leigh. Leigh’s efforts are being supported by Grassroots Horse, an organization based in grassroots activism to prevent cruel wild horse roundups.

“If this roundup were being conducted in a safe manner,” says Leigh’s attorney Gordon Cowan of Reno, Nevada “one would make the assumption that the BLM would want the public to witness its entirety. Barring observers and press raises concerns.”

HOUSTON, (Horseback) - On January 22, 2010 I was given a tour of the Fallon holding facility after my observation days (Calico gather) had been cancelled by weather twice.
I had witnessed the gather on January 16, and met Gene Seidlitz (Winnemucca district manager) and Heather Emmons, both of the Bureau of Land Management. Both appeared to be very willing to accommodate and provide access in as transparent a manner as possible Gene spoke to me many times about the concept of finding areas for dialogue and co-operation. I had hoped to write an article based on that concept.
On January 22, Seidlitz and Lisa Ross, BLM public relations coordinator for Calico gather met me at the agency’s Fallon facility. John Neill is acting BLM manager at Fallon. I was given free access to photograph and ask questions. I was also allowed to videotape the “hospital” facility at Fallon. I soon saw a row of small pens near the entrance to the facility next to the area being built to process horses. The plywood for windbreaks was stacked but not installed.
The pens held mostly foals and a few mares. Each horse I saw demonstrated some form of lameness. Many had bandages on their legs. Of particular concern was a foal that would not rise when approached.. His eyes were glassy.
Over the next few days I made several attempts to gain information about that foal. I sent e-mails to Gene, Lisa, and John. I was told the foal was up the very next day and doing well. Information I found hard to believe because I did not think he would even make it through the night. I requested a vet report and was told I would have it as soon as one was available. I requested that the foal be released to me and I would facilitate his placement into a facility that could properly care for him. The request was denied, the BLM saying it was not needed.
I named him “Hope Springs Eternal.” I began to make inquiries to find a facility to bring him to. He would have a home.
Several more conversations with John Neill continued to assure me the foal was fine. John said he was busy and if I did not get the vet report to please call him again.
I called today. I was told the vet report is online. It’s not. He was euthanized Saturday because his hooves had begun to slough.
My emotions are many:
So much for a timely exchange of information. So much for the concept that the “guys on the ground” are any different than the guys in DC, something they want you to believe. So much for the idea that co-operation toward problem solving with the best interests of the horses at its heart will ever be a reality. So much for “ Hope Springs Eternal.”
The baby I saw on January 22 was in incredible pain to the point that, as a wild animal, he could hardly lift his head as a strange human, a potential predator, approached. All the others rose and limped away. This baby languished in that facility with no windbreak in agony. A baby that had a chance if the humans involved could have attempted to create an opportunity to work together. Releasing that foal would have cost the BLM nothing… and maybe created the sensation that somewhere in this madness a spirit of humanity could overcome this battle of obstinate adherence to outdated bureaucratic protocol. I had “Hope.”
Little spirit you are now free of this administration’s unwillingness to recognize your worth. “Hope Springs Eternal,” rest in peace. You are loved.
